Introduction

LookHealth Inc. (“LookHealth”, “we”, or “us”) values and respects the privacy of its Users. We are committed to safeguarding the personal information that users (the “User” or “you”) share with us through our online website and services (collectively, the “Products”). This privacy policy (the “Policy”) outlines how we collect, use and disclose personal information when the User visits our website, uses our services, or otherwise interacts with us.

This Policy is designed to prevent unauthorized use of Users’ personal information and is prepared in accordance with the federal Personal Information Protection and Electronic Documents Act (“PIPEDA”) and Alberta’s Personal Information Protection Act (“PIPA”).

This Policy applies to all Products that are now offered or may be offered from time to time.  Unless otherwise stated, when new Products are introduced or current Products are amended, they will be subject to this Policy.

We may update this Policy from time to time and will note the most recent revision date at the bottom of this page. We encourage Users to periodically review this page to ensure they are familiar with those changes. By continuing to use the Products for any purpose, it is understood that the User consents to the collection, use, storage and disclosure of their personal information in accordance with this Policy.

Accountability and Protection of Personal Information

LookHealth’s services include biomarker test kits, DNA test kits, and follow up consults with a LookHealth advisor. In most jurisdictions, LookHealth has overall responsibility for protecting the User's personal information, including personal health information. We have implemented technical, administrative and physical security measures to protect the personal information of the Users from unauthorized access and improper use.  We also protect the Users’ personal information offline.  Security measures are regularly reviewed and updated when required.

Although we use commercially reasonable efforts to protect your personal data and information, transmission of information over the internet is difficult to completely secure. LookHealth is not responsible for circumvention of any privacy settings or security measure contained on the website.

Collection and Use of Personal Information

Privacy legislation defines personal information as any information about an identifiable individual, and includes, but is not limited to, an individual’s name, home address, phone number, email address, date of birth, health, lifestyle or medical information, ID numbers, payment information, and bank information. We do not test for paternity, relatives, or identity markers.

Personal information is collected to identify, contact, and provide support to the User. Without limiting the generality of the foregoing, we may collect personal information when the User:

  • Registers for and uses our services;

  • Pays for our services;

  • Signs up to receive marketing emails, such as newsletters and updates;

  • Enters a contest or participates in a promotion;

  • Participates in a LookHealth survey;

  • Applies for a job at LookHealth;

  • Contacts us.

Information about our Website

Information may be collected directly from the device used to access the Products, including:

  • Internet Protocol (IP) address of computer/phone accessing the Products;

  • The types of operating systems and web browsers being used to access;

  • The Internet Service Provider (ISP) that is used by the Users;

  • Date and time information;

  • Pages visited, length of stay on pages and webpage interaction information;

  • Information searches; and

  • Mobile device ID and manufacturer.

The information collected from the Users’ devices may be obtained using the following techniques:

  • “Cookies” are data files that are placed on the Users’ devices or computer and often include an anonymous unique identifier. The User can set their browser to notify them when they receive a cookie or to not accept cookies. However, if the User decides not to accept cookies from our website, the User may not be able to take advantage of all its features.

  • “Log Files” track actions occurring on the Products, and collect data including the Users’ IP address, browser type, ISP, referring/exit pages, and date/time stamps.

  • “Web beacons”, “tags”, and “Pixels” are electronic files used to record information about how Users use the Products.

LookHealth currently uses Stripe as a third-party payment processor for the Products. When the User makes a purchase with LookHealth, the User is also subject to Stripe’s various privacy policies and terms of use.

LookHealth uses DigitalOcean as a cloud infrastructure and hosting provider for our website, online store and customer portal. In providing these services, DigitalOcean may process and store personal information on LookHealth’s behalf and in accordance with our instructions and applicable contractual and privacy requirements. The User’s use of LookHealth’s website, online store and customer portal is governed by this Policy and LookHealth’s Terms of Use.

Our website contains links to other websites that LookHealth does not own or operate. We provide links to third-party websites as a convenience to the User. When the User accesses the third-party websites, the User is subject to their various privacy policies and terms of use.

Sharing of Personal Information

We may share the User's information with any companies affiliated with LookHealth, with third parties who provide services to LookHealth or to the User, with other third parties for legitimate business purposes associated with the Products, or as required to comply with legal obligations.

The User's personal information will be disclosed to certain third parties that provide services on our behalf, including but not limited to, laboratory testing services, hosting the website, processing payments, providing analytics, and advertising and marketing services. Our service providers are only provided with the information they need to perform their specific functions and are not authorized to use or disclose personal information for their own marketing or other purposes. We and our service providers may access, store and otherwise process personal information outside of Canada, including in the United States or other foreign jurisdictions where we or our service providers are located. The User's personal information may be accessible to law enforcement and national security authorities of those jurisdictions. In particular, blood samples are tested by our contracted laboratories in the United States, and the records maintained by those laboratories are stored in the United States.

Genetic data is never shared with third parties except as required to provide services or by law.

Business Transfers

If LookHealth is involved in a merger, acquisition, reorganization, or sale of all or part of its business, the User's personal information may be transferred as part of that transaction. In such cases, we will take steps to ensure that the User's personal information continues to be used only for the purposes set out in this Policy, or as otherwise permitted or required by law. If a transfer occurs, we will require the acquiring organization to agree to protect the User's personal information in a manner consistent with this Policy and applicable privacy laws. We will notify the User before their personal information is transferred and becomes subject to a different privacy policy. At that time, the User will also be given the opportunity to contact us with any questions or requests regarding their data before the transfer is completed.

Do Not Track

Please note that LookHealth does not alter the website’s data collection and use practices when we see a Do Not Track Signal from the User's browser.

Consent to Collection

Upon a User creating an account with the Products or otherwise submitting their personal information to LookHealth, the User consents to the collection, use, storage and disclosure of their personal information in accordance with the terms of this Policy.  If LookHealth wishes to use or disclose the User’s personal information for any purpose not set out in this Policy, LookHealth may ask for additional consent. The Users may withdraw any consent at any time by emailing or writing to us using the contact information set out below, unless withdrawal of such consent would frustrate the performance of a legal obligation.

Storage and Disclosure of Personal Information Outside of Canada

We use MySQL for the storage of certain personal information of the users.  MySQL has servers distributed throughout the United States and Canada and as otherwise disclosed on the webpage of MySQL. The User’s personal information will be stored on the MySQL for the following purposes:

  • For the efficient carrying out of the services provided by LookHealth and its service providers;

  • For the storage of the Users’ personal information in a secure format; and

  • For processing of payment for requests of services submitted through the Products.

We may also use Google Analytics to assist with understanding how the Users use the Products.

Data Retention

We will retain the Users' personal information for as long as it is reasonably required to achieve the purposes for which the information was obtained, as further detailed elsewhere in this Policy, and to meet our legal, regulatory, accounting and dispute-resolution obligations. When we determine that the information is no longer reasonably required for its business or legal purposes, we will securely destroy the records containing the Users' personal information or render the personal information non-identifying so that it can no longer be used to identify an individual.

Testing is performed by our accredited laboratories, which retain certain records, including test requisitions and results, in accordance with applicable laws, accreditation standards and their own retention policies. These records are maintained by the laboratories separately from LookHealth and may be retained for the applicable retention period even if the User closes their account or requests the deletion of their personal information.

Samples

LookHealth does not receive or handle the Users’ biological samples. Samples are shipped by the User directly to a certified laboratory and are used for the tests ordered by the User. Following testing, the laboratory retains samples for a limited period in accordance with its procedures and applicable requirements, after which they are disposed of. Samples are never used for research without the User’s explicit consent. DNA samples submitted for Nutrigenomix testing are subject to Nutrigenomix’s own policies.

Notification of Security Breaches

Should we become aware of any data breaches where there exists a real risk of significant harm to the individual whose information has been compromised, we will, as required by law, notify the Information and Privacy Commissioner under the Freedom of Information and Protection of Privacy Act, together with any impacted individuals, as soon as feasible after the breach, so that steps may be taken to reduce any potential harm.

Access to Information

Subject to the exceptions set out in PIPA, each User has a right to access their own personal information that has been collected and is under our control and to request a correction for any incorrect information. The User may make a request to access or correct their personal information by contacting us at the email address set out below.  The User should provide sufficient information in their request to allow us to identify the information that is being requested and the reason why it has been requested.‍

Each User may also request the deletion of their personal information by contacting us at the email address set out below. We will delete the User's personal information to the extent possible; however, certain records may need to be retained to meet legal or regulatory obligations, including the laboratory records described under Data Retention.
